The Supreme Court held that under Section 33 of the Insecticides Act, 1968, a person can be held liable for an offence committed by a company if they were in charge of the business at the time of the offence. The Court found that the High Court erred in quashing the summons against the respondent, Rajiv Khurana, as he was identified as responsible for quality control, thus establishing a prima facie case for his liability. The appeal by the State of Delhi was allowed, reinstating the summons issued by the trial court.
