Judgment text excerpt

The Supreme Court held that under Section 34 of the Arbitration and Conciliation Act, 1996, the limitation period for setting aside an arbitral award is three months from the date of receipt of the award, with a further condonable delay of thirty days if sufficient cause is shown. The Court affirmed the High Court's decision that the appellant's petition filed on 11.3.2008 was barred by limitation as it was beyond the prescribed period of three months plus thirty days. Consequently, the appeal was dismissed, upholding the dismissal of the application for condonation of delay.
