The Supreme Court held that the High Court erred in not addressing the appellant's claim for the pay scale of Rs.3050-4590 applicable to Mason Grade-II, as no material was presented regarding the applicable pay scales. The Court clarified that while the appellant could not be regularised in the post of Mason Grade-II due to the absence of a vacant post, the issue of pay scale must be reconsidered. Consequently, the Court set aside the High Court's order and restored the writ petition for the determination of the appropriate pay scale.
