Judgment text excerpt
The Supreme Court addressed the claim of a suspended government servant for revision of subsistence allowance under the Central Civil Services (Revision Pay) Rules, 1997. The Court upheld the Central Administrative Tribunal's decision that it would be unjust to deny revised subsistence allowance to those suspended before January 1, 1996, while allowing those suspended after that date to receive it. The Court affirmed that the respondent was entitled to arrears of revised subsistence allowance from January 1, 2002, until his dismissal on August 4, 2005, but not for the period prior to that due to his failure to challenge the earlier rejection of his claim.
