Judgment text excerpt

The Supreme Court upheld the High Court's decision affirming the Additional District Judge's ruling that the Sainath Mandir Trust's claim to the suit property, based on a gift deed dated 31.1.1974, was valid. The Court found that the gift deed effectively divested the original owner of title, and the Trust's continuous possession since 1974 was legally justified. The Court ruled that the subsequent sale deed executed by the original owner to the plaintiff did not invalidate the Trust's rights under the gift deed, thus dismissing the appeal.
