The Supreme Court addressed the issue of promotion and pay fixation for Stock Verifiers in the Indian Railways, specifically under the guidelines set by the Railway Board and the recommendations of the Fifth Pay Commission. The Court held that the additional increments granted for passing the qualifying examination should be considered part of the basic pay for the purpose of calculating Dearness Allowance, thereby establishing that such increments cannot be arbitrarily excluded from basic pay calculations. The Court set aside the impugned communication dated 08.05.1996 which denied this inclusion, thereby favoring the appellant's claim for rightful pay benefits.
