Judgment text excerpt

The Supreme Court upheld the Bombay High Court's decision affirming the disqualification of certain members of the Bhor Municipal Council under Rule 3(1)(a) of the Maharashtra Local Authority Members Disqualification Rules, 1987. The Court found that the formation of the Bhor Shahar Vikas Swabhimani Sanghathana by six councillors from NCP constituted a violation of the disqualification rules, as they failed to follow proper procedures for resignation and reformation of party affiliation. Consequently, the Court dismissed the appeals, affirming the High Court's ruling regarding the disqualification of the petitioners.
