Judgment text excerpt

The Supreme Court addressed the validity of a sale-deed executed on 6th July 1974 under which agricultural land was allegedly transferred as security for a loan of Rs. 6,000. The Court held that the sale-deed was not executed as security and affirmed the Trial Court's findings that the plaintiff failed to prove the agreement regarding the return of the land. Consequently, the appeal was dismissed, upholding the lower court's decision regarding possession and the validity of the sale-deed under Section 54 of the Transfer of Property Act, 1882.
