The Supreme Court held that under the Hindu Succession Act, 1956, Shingari inherited only a 1/10th share of Soran's property, and thus had no authority to alienate the property to her son from a previous marriage, Man Singh. The Court found that the decree dated March 9, 1979, which favored Man Singh based on a family settlement, was null and void as it contravened the statutory rights of Soran's legal heirs. Consequently, the Court upheld the High Court's decision to restore the trial court's decree, affirming the rightful inheritance of Soran's property.
