Judgment text excerpt
The Supreme Court upheld the Delhi High Court's decision to quash the Rate Contract No. S-140013/4/2008-OP/100 dated 2nd December, 2008, awarded to Indian Drugs & Pharmaceutical Ltd. (IDPL) for the supply of Oral Contraceptive Pills (OCPs). The Court found that the tender process was flawed as the Union of India failed to provide necessary documents to Famy Care, which hindered their participation in the tender. The judgment reinforces the principle that fair opportunity must be provided to all eligible bidders in public procurement processes under Article 14 of the Constitution.
