Judgment text excerpt

The Supreme Court held that under Section 18-A(2) read with Schedule II of the East Punjab Urban Rent Restriction Act, 1949, the date of knowledge for the tenant regarding eviction proceedings should be considered as 9.8.2006, as there was no personal service of notice. The Court found the High Court's inference that the notice was deemed served on 1.7.2006 to be unjustified, as it lacked supporting evidence. Consequently, the Supreme Court set aside the High Court's order and restored the Rent Controller's decision allowing the tenant to contest the eviction proceedings.
