The Supreme Court addressed the legality of the U.P. Government Servants Seniority (3rd Amendment) Rules, 2007, which aimed to alter the seniority of government servants based on caste reservations. The Court held that the seniority of employees prior to the enforcement of these rules should remain undisturbed, affirming the applicability of the U.P. Jal Nigam (Public Health Branch) Service Regulations, 1978, and the Uttar Pradesh Public Services (Reservation for Scheduled Caste, Scheduled Tribes and other Backward Classes) Act, 1994. The Court emphasized that the provisions of Article 16(4-A) of the Constitution, allowing for reservation in promotions, must be interpreted in light of the precedent set in Indira Sawhney vs. Union of India, which limited such reservations.
