The Supreme Court set aside the High Court's order dated 1.2.2002 which had remanded the case for retrial, holding that the Trial Court had taken a passive approach and failed to actively involve itself in the remand process. The Court noted that the prosecution did not intend to adduce any further evidence, and thus, remitting the matter for reconsideration would serve no useful purpose.
