The Supreme Court upheld the High Court's decision to set aside the election of the appellant under Section 100(1)(b) of the Representation of People Act, 1951, due to corrupt practices as defined in Sections 123(3) and 123(5) of the Act. The Court found that the appellant had engaged in corrupt practices by distributing election materials that violated electoral conduct and by providing free transportation to voters. Consequently, the election petitioner was declared elected in accordance with Section 101(b) of the Act.
