Judgment text excerpt

The Supreme Court addressed the issue of pay fixation for a member of the Indian Police Service (IPS) who experienced a reduction in pay upon induction from the state police service. The Court examined the IPS (Pay) Rules, particularly Clauses (iii) & (iv) of Schedule II, and Rule 6 of Section III, concluding that the fixation of pay was arbitrary and unreasonable. The Court held that the applicant's pay should be fixed based on his previous higher pay in the state cadre, thereby allowing the appeal and directing the appropriate authorities to rectify the pay anomaly.
