Judgment text excerpt

The Supreme Court held that the invocation of Section 17(2)(c) of the Land Acquisition Act, 1894, which allows for urgent acquisition, must be accompanied by a clear indication of reasons for bypassing Section 5-A, which provides for objections to acquisition. The Court found that the appellants were denied their right to file objections, rendering the notifications under Sections 4 and 6 arbitrary and contrary to the provisions of the Act. Consequently, the Court quashed the notifications and upheld the appellants' right to contest the acquisition.
