The Supreme Court modified the Delhi High Court's judgment in Motor Accident Claims Appeal No.239 of 2004, holding that the correct multiplier under the Motor Vehicles Act, 1988 should be 17 instead of 14 for calculating compensation for the death of Pankaj Gupta. The Court also determined that one-third of the deceased's income should be deducted as personal expenditure, resulting in a revised compensation amount of Rs.13,40,892, along with additional amounts for future prospects, funeral expenses, and loss of love and affection. The Insurance Company was directed to pay the modified compensation with interest at 9% per annum within four weeks.
