The Supreme Court allowed the appeal by the Ghaziabad Development Authority, setting aside the National Commission's order and modifying the State Commission's decision. The Court directed the Authority to allot Plot No.E-3 in the Swarn Jayanti Puram Scheme at a reduced rate of Rs.2300 per sq. mt. and deliver possession within three months. The Court held that the delay in possession was due to circumstances beyond the Authority's control, and thus, the question of charging interest at 18% per annum did not arise, with the respondent entitled to adjustment of amounts already paid with interest at 9%.
