The Supreme Court granted a decree of divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955, after determining that the parties had been living separately for over four years and had no chance of reconciliation. The Court noted that the parties had filed appropriate applications and affidavits supporting their claim of irretrievable breakdown of marriage. Consequently, the Divorce Petition No.1118 of 2008 was transferred to the Supreme Court and the marriage was dissolved accordingly.
