Judgment text excerpt

The Supreme Court reviewed its earlier order dismissing SLP (Crl.) No.6974 of 2008, allowing the petitioner to compound the offence under Section 138 of the Negotiable Instruments Act after the petitioner demonstrated that he had paid the full amount of Rs.4,52,289/- to the respondent as per a compromise. The Court held that the provisions of Section 147 of the Negotiable Instruments Act permit compounding of offences, and since the respondent expressed willingness to compound, the conviction was set aside. The Court also allowed the delay in filing the review application to be condoned.
