The Supreme Court held that non-compliance with Section 13(2) of the Food Adulteration Act, which mandates proper service of the Public Analyst's report to the accused, infringes the accused's right to have the sample re-examined by the Central Food Laboratory. Consequently, the Court acquitted the appellant of the charges and allowed the appeal, discharging his bail bonds.
