The Supreme Court held that the High Court's reliance on the judgment in In Re: Suresh Chandra Sharma & Anr. v. State of Uttaranchal & Ors. was misplaced, as that decision had been overruled in Uttaranchal Forest Rangers Association (Direct Recruits) & Ors. v. State of Uttar Pradesh & Ors. The Court set aside the High Court's order and remanded the matter for reconsideration in light of the correct legal position established in the latter case. The appeal by the State of Uttarakhand was thus allowed, with no order as to costs.
