COMMR.OF CUSTOMS vs M/S AJAY KUMAR & CO.

The Supreme Court upheld the decision of the Punjab & Haryana High Court and the Customs, Excise & Service Tax Appellate Tribunal (CESTAT) which dismissed the appellant's appeal regarding a demand of Rs.12,45,174 under the Customs Act, 1962. The Court found that the show cause notices did not attribute any infraction to the appellant concerning the licenses transferred from M/s. Parker Industries, thus confirming the demand was barred by limitation. The appeal was dismissed as the judgments did not suffer from any infirmity.
