The Supreme Court set aside the Punjab & Haryana High Court's judgment affirming the entitlement of the respondent to disability pension, citing the decisions in Union of India & Others Vs. Keshar Singh and Union of India & Others Vs. Surinder Singh Rathore. The Court held that the respondent's disability was not attributable to military service and that he had not completed the requisite service period for pension eligibility. However, it ruled that any payments already made to the respondent shall not be recovered.
