The Supreme Court allowed the appeal against the Uttarakhand High Court's dismissal of the insurer's appeal under Section 166 of the Motor Vehicles Act, 1988, holding that the High Court erred in concluding that the insurer did not obtain leave to contest as required under Section 170 of the Act. The Court found that leave to contest was indeed granted on 25.4.2001, which the High Court overlooked. Consequently, the Supreme Court quashed the High Court's orders and directed it to dispose of the matter expeditiously.
