The Supreme Court set aside the Uttarakhand High Court's order dismissing the insurer's appeal under Section 166 of the Motor Vehicles Act, 1988, on the grounds that the High Court overlooked the fact that leave to contest was granted to the insurer on 25.4.2001. The Court held that the High Court should have reviewed its earlier order based on this factual error and directed the High Court to dispose of the matter expeditiously. The appeal was allowed, quashing the previous orders of the High Court.
