The Supreme Court held that the claimant's acceptance of compensation from another insurance company for the same accident does not bar him from claiming statutory liability from the tortfeasor. The Court found that the High Court failed to consider the prior settlement adequately, which involved a payment of Rs.21,700/- for the same cause of action. Consequently, the Supreme Court set aside the High Court's order and remitted the matter for fresh consideration, allowing the appeal.
