The Supreme Court held that the High Court erred in not considering the effect of the notification issued under Section 43-A of the Bombay Tenancy and Agricultural Lands Act, 1948, when it set aside the orders of the Maharashtra Revenue Tribunal and the Sub-Divisional Officer. The Court found the High Court's order to be legally infirm and thus allowed the civil appeal, remitting the matter back to the High Court for fresh consideration of the writ petition. The High Court was directed to dispose of the matter within six months.
