The Supreme Court held that under Section 14(1)(a) and Section 14(2) of the Delhi Rent Control Act, 1958, a tenant who has previously availed the benefit of Section 14(2) cannot claim the same benefit in the event of a second default in rent payment. The Court found that the respondent's refusal to accept the money order for arrears did not absolve him from the obligation to deposit the rent with the Rent Controller as per Section 27 of the Act. Consequently, the Court upheld the eviction order against the respondent, reversing the High Court's decision that had ruled in favor of the tenant.
