The Supreme Court allowed the appeal, setting aside the High Court's judgment dated January 12, 2004, which had granted the petitioner a revised pay scale of Rs. 3700-5700. The Court found that the revised pay scale for the Workshop Superintendent of Agnel Polytechnic, Verna, had been withdrawn prior to the High Court's decision, and thus the petitioner was not discriminated against as both were on the same pay scale of Rs. 2200-4000. The matter was remanded back to the High Court for reconsideration in light of this fact.
