Judgment text excerpt

The Supreme Court clarified that under the principles established in National Insurance Company Limited vs. Laxmi Narain Dhut [2007 (3) S.C.C. 700], an insured cannot claim compensation for damage to their vehicle if the driver's license is fake. The Court held that since the insured-respondent sought compensation for damage to his own vehicle and not for third-party claims, the ruling in Laxmi Narain Dhut's case applies directly. Consequently, the appeal was allowed, and the orders of the State Commission and National Commission were set aside, restoring the District Forum's dismissal of the complaint.
