Judgment text excerpt

The Supreme Court addressed a contempt application against tenants for failing to comply with an order to vacate premises by March 31, 2008, as per the undertaking filed in compliance with the order dated October 1, 2007. The Court found the tenants' conduct to be contemptuous due to the delay in vacating the premises until July 14, 2009, but opted not to initiate contempt proceedings given that possession was eventually delivered. Instead, the Court directed the tenants to pay all arrears of rent and a cost of Rs. 30,000 to the landlord, to be paid within four weeks, failing which further orders would be issued.
