Judgment text excerpt

The Supreme Court set aside the interim mandatory order of the High Court directing the appellant to put the judgment-debtor in possession of the property, as the appellant, being the decree holder, had already taken possession through court. The Court held that redelivery of possession to the judgment-debtor cannot occur until a final order is made in the pending civil revision case. The Court directed that the appellant shall not alienate or part with the property until the High Court disposes of the civil revision case, requesting expedited resolution within six months.
