The Supreme Court allowed the appeal of the Union of India against the dismissal of their Writ Petition (WPCT No. 208 of 2007) by the Calcutta High Court. The Court found the High Court's earlier judgment to be cryptic and lacking discussion on relevant Service Rules. Consequently, the Supreme Court set aside the impugned judgment and restored the Writ Petition for fresh hearing, directing the High Court to dispose of it in accordance with law within nine months.
