The Supreme Court upheld the Delhi High Court's decision to allow Writ Petition No. 21211 of 2005, which mandated that a maximum of 15 years of practice at the Bar be considered for pension calculations for direct recruits to the Delhi Higher Judicial Service. The Court emphasized that without this provision, many recruits would not achieve full pension benefits, as the minimum service required is 33 years. The Court directed the government to amend the Delhi Higher Judicial Service Rules, 1970, to incorporate this weightage for pension and retiral benefits.
