The Supreme Court upheld the Delhi High Court's decision to grant weightage of 15 years of practice at the Bar for direct recruits to the Delhi Higher Judicial Service while computing pension and retiral benefits, as per the proposed Rule 26(B) in the Delhi Higher Judicial Service Rules, 1970. The Court found that without this weightage, candidates joining at age 35 would not achieve the requisite 33 years of service for full pension, thus violating principles of fair and reasonable service conditions. The appeal by the Government of NCT of Delhi was dismissed, affirming the High Court's order.
