The Supreme Court ruled that the U.P. Basic Education Act, 1972, specifically Section 13, mandates that only candidates with recognized qualifications such as BTC, HTC, or JTC can be appointed as Assistant Teachers in Basic Schools. The Court held that the CPEd Certificate, which was not recognized by the State Government as equivalent, does not qualify candidates for these posts. Consequently, the Board's decision to entertain applications from CPEd holders was invalidated, and the fresh advertisement restricting qualifications was upheld.
