Judgment text excerpt

The Supreme Court upheld the Karnataka High Court's dismissal of an appeal under Section 173 of the Motor Vehicles Act, 1988, challenging the MACT's award of Rs. 11,04,032 as compensation for the death of T.S.C. Shekar due to a bus accident. The Court found that the claimants failed to substantiate the argument that the deceased was intoxicated and solely responsible for the accident, as there was no evidence or pleading to support this claim. The Court modified the compensation amount to Rs. 8,53,296, applying a multiplier of 8 based on the deceased's age of 53 years, and maintained the interest rate at 6% per annum from the date of the claim.
