Judgment text excerpt

The Supreme Court examined the recognition and funding status of educational institutions under various Uttar Pradesh statutes, specifically the U.P. Basic Education Act, 1972, the U.P. Recognized Junior High Schools (Payment of Salaries of Teachers and Other Employees) Act, 1978, the U.P. Intermediate Education Act, 1921, and the U.P. High Schools and Intermediate College (Payment of Salaries of Teachers and Other Employees) Act, 1971. The Court held that institutions recognized after June 30, 1984, were not eligible for the grant-in-aid scheme and must operate on a self-financing basis for higher classes. The ruling clarified that the amendment to the 1921 Act allowing for self-financing recognition does not retroactively apply to institutions denied aid prior to the cutoff date.
