The High Court of Judicature at Allahabad stayed the transfer order dated May 15, 2009, of Rajeev Ratan Pandey, Senior Manager, Engineering, from Lucknow to Calicut. The Court found that the allegations of mala fides made by the respondent were an afterthought, as they were not present in the initial writ petition filed on June 1, 2009, and were only introduced in a supplementary affidavit on July 3, 2009. The Court reiterated that the burden of proving mala fides lies with the person making the allegations and must be supported by convincing evidence, as established in State of U.P. v. Gobardhan Lal (2004) 11 SCC 402.
