Judgment text excerpt
The Supreme Court held that the High Court erred in upholding the grant of disability pension to A.V. Damodaran, as the Medical Board's report clearly stated that his schizophrenia was neither attributable to nor aggravated by military service, as per Regulation 173 of the Pension Regulations for the Army, 1961. The Court emphasized that the opinion of the Medical Board must be given due weight in determining eligibility for pension. Consequently, the appeal was allowed, and the High Court's order was set aside.
