The Supreme Court held that the appellants should not be deprived of their rightful claim for enhanced compensation due to non-payment of requisite court fees without being given an opportunity to pay the deficit. The Court set aside the High Court's judgment in part, fixing the market value of the acquired land at Rs. 23/- per sq. ft. as determined by the High Court, while affirming the rest of the decision. The Court directed that enhanced compensation would be paid if the appellants deposit the requisite court fees within four months, failing which the appeals would be dismissed.
