Judgment text excerpt
The Supreme Court convicted the appellants under Section 304(II) IPC, sentencing appellant No. 2, Ghanshyam, to 45 months R.I. and a fine of Rs. 1,25,000, while appellant No. 1, Raghu, was fined Rs. 75,000. The Court noted that Ghanshyam had undergone 36 months of his sentence and compensated the deceased's wife. Considering the peculiar circumstances, including the time elapsed since the incident in 1988 and the compensation paid, the Court reduced Ghanshyam's sentence to the time already served, while dismissing the appeal for Raghu.
