SC 1997/18401
Court
Supreme Court of India
Petitioner
STATE OF PUNJAB
Respondent
SANGHU SINGH

Judgment text excerpt

The Supreme Court allowed the appeal by the State of Punjab, setting aside the High Court's order that directed the re-computation of pensionary benefits for the respondents based on their service in Local Body schools prior to 1.10.1957. The Court found that the High Court's decision was not in line with its previous judgments in State of Punjab & Ors. Vs. Dev Dutt Kaushal and State of Punjab & Ors. Vs. Harnam Singh, which established that such benefits were not due. The writ petition was dismissed, but it was clarified that no recovery would be made if benefits had already been paid.
