The Supreme Court addressed the validity of Circulars issued by the Registrar of Co-operative Societies regarding the applicability of Section 101 of the Maharashtra Co-operative Societies Act, 1960, in light of the Multi-State Co-operative Societies Act, 2002. The Court found that the High Court had not answered the pertinent legal question of whether the State Authority could invoke the 1960 Act for a society registered under the 1984 Act. Consequently, the case was remitted to the High Court for consideration, while directing the respondent to initiate proceedings under the 2002 Act and maintain the attachment on the appellant's assets until interim orders are passed by the Competent Authority under the new Act.
