Judgment text excerpt

The Supreme Court upheld the Bombay High Court's dismissal of the appellant's writ petition challenging notifications under Section 15(1) of the Maharashtra Resettlement of Project Displaced Persons Act, 1976 and Sections 4 and 6 of the Land Acquisition Act, 1894. The Court ruled that the compromise regarding land partition, executed after the notification under Section 11(1) of the Resettlement Act, was void ab initio and could not be considered. Consequently, the Court affirmed the legality of the notifications and the acquisition process as valid under the relevant statutes.
