Judgment text excerpt

The Supreme Court held that under Section 166 of the Motor Vehicles Act, 1988, the calculation of compensation must consider the revised pension of the deceased, Suraj Bhan, which was increased from Rs.3,228/- to Rs.4,556/- per month. The Court found that the High Court erred in not considering this revised amount, leading to an inadequate compensation award. The Court recalculated the dependency at Rs.2,200/- per month, resulting in a total compensation of Rs.2,90,400/- with interest at 12% per annum from the date of the original petition.
