The Supreme Court held that the Division Bench of the High Court erred in reversing the order of the learned Single Judge without providing notice or an opportunity to the appellant to be heard, violating the principles of natural justice. The Court set aside the impugned order and remitted the matter back to the Division Bench for a fresh decision in accordance with law, preferably within three months. The appeal was allowed with no order as to costs.
