Judgment text excerpt
The Supreme Court directed that recruitment to the Higher Judicial Service (HJS) should consist of 50% by promotion based on merit-cum-seniority, 25% by merit through a limited competitive examination for Civil Judges (Senior Division) with at least five years of service, and 25% by direct recruitment from eligible advocates through written and viva voce tests. This decision aims to enhance the quality of the HJS by providing a fast track for meritorious subordinate judicial officers and ensuring a competitive selection process. The Court emphasized the need for High Courts to frame appropriate rules to implement these directives, thereby improving the caliber of the judiciary.
