The Supreme Court upheld the Punjab and Haryana High Court's decision to grant Major Generals who retired before January 1, 1996, the revised pay scale benefits, as per the recommendations of the Fifth Pay Commission. The Court found that the disparity in pension payments between Major Generals and Brigadiers was unjust, as Major Generals historically received higher pay and pension. The Court directed the Union of India to fix the minimum pay scale for Major Generals above that of Brigadiers, thereby ensuring equitable treatment for all officers of the same rank.
